Arkansas Law Now Prohibits PBMs from Owning Pharmacies

Arkansas now has a first-of-its-kind law after Governor Sarah Sanders signed legislation that impacts pharmacy benefit managers (PBMs). The new law prevents PBMs from owning and operating both retail and mail-order pharmacies within the state. This law establishes a unique regulatory framework in Arkansas. Specifically, it prohibits a PBM from simultaneously managing prescription drug benefits and directly dispensing medications to patients through both brick-and-mortar retail pharmacies and mail-order services. The Arkansas legislature passed the bill before it was signed into law by Governor Sanders.
