Five Federal Laws That Established the Modern U.S. Mortgage Framework

Five specific pieces of federal legislation established the modern framework for homeownership in the United States by expanding access to credit and standardizing mortgage practices. These laws—the Federal Home Loan Bank Act of 1932, the Home Owners’ Loan Act of 1933, the National Housing Act of 1934, the Servicemen’s Readjustment Act of 1944, and the Housing and Urban Development Act of 1968—collectively shifted the housing market from a system of short-term, high-interest loans to the long-term, fixed-rate mortgage model used today.

The Federal Home Loan Bank Act of 1932 created a system of regional banks to provide liquidity to local lenders, while the Home Owners’ Loan Act of 1933 introduced the Home Owners’ Loan Corporation to refinance mortgages for those facing foreclosure during the Great Depression. Shortly after, the National Housing Act of 1934 established the Federal Housing Administration (FHA), which introduced mortgage insurance to encourage lenders to offer lower down payments and longer repayment terms. Following World War II, the Servicemen’s Readjustment Act of 1944, commonly known as the G.I. Bill, provided government-backed home loans to veterans, significantly increasing the number of Americans eligible for home financing. Finally, the Housing and Urban Development Act of 1968 expanded the role of the Government National Mortgage Association (Ginnie Mae) to support the secondary mortgage market, ensuring a steady flow of capital to lenders and further stabilizing the availability of home loans for the general public.
