U.S. Solicitor General Advises Supreme Court Not to Review Oklahoma PBM Regulation Law

The U.S. solicitor general has advised the Supreme Court against reviewing an Oklahoma law that regulates pharmacy benefit managers (PBMs). The recommendation aligns with a previous decision by an appeals court, which upheld three provisions of the state law challenged by a PBM trade group.

The case centers on whether certain aspects of Oklahoma’s legislation conflict with federal laws governing employee benefits and Medicare. Specifically, the PBM trade group argued that the provisions are preempted by the Employee Retirement Income Security Act (ERISA), which sets national standards for employer-sponsored health plans. The solicitor general concluded that these provisions do not interfere with ERISA or Medicare regulations and supported the appeals court’s interpretation. This development marks another step in ongoing debates over state-level efforts to regulate PBMs, entities that play a significant role in managing prescription drug benefits across the country.
